If we're talking US law specifically, Section 230 should make the hoster immune from prosecution for content uploaded by users. In theory archived material could be used as evidence against the original uploader, but I don't know that that would be likely in practice if nothing happened on account of the original uploading itself, particularly since the archival process may lose non-public information about the uploader

So, the problem is copyright. The Internet Archive seems to be exempted from DMCA for certain content:

Web Archives in general are legal and are exempt from most forms of copyright, and are useful for actual legal evidence, so even if they get sued for books, the web archive has been used in legal cases many times, and would make no sense to remove it.
